TERMS AND CONDITIONS OF USE FOR ZHOMES REAL STATE

These Terms and Conditions (hereinafter, the “Terms”) govern the access to and use of the ZHomes Real State mobile application (hereinafter, the “Application”), developed and operated by ZHomes Real State LLC, located at 7520 Preston Hwy, Louisville, KY 40219 (hereinafter, “ZHomes,” “we,” or “our”). By installing, accessing, or using the Application, you (hereinafter, the “user” or “you”) acknowledge that you have read and agree to these Terms. If you do not agree, please refrain from using the Application.

1. PURPOSE OF THE APPLICATION
1.1. ZHomes provides users with a platform to view properties for sale published by ZHomes and other real estate brokers.
1.2. The information about properties from other brokers is obtained through an API from SPARK, for which ZHomes pays a monthly fee.
1.3. The main goal is to facilitate users’ search for real estate in different locations and enable them to contact ZHomes for assistance in purchase, sale, or rental processes.

2. ACCESS AND REGISTRATION
2.1. Registration with an Email Account

Users can create an account using their email address, which may allow them to save searches, favorites, and receive relevant notifications.
2.2. Guest Access

Users can choose to navigate the Application without providing personal data. In that case, access to certain features, such as saving searches and favorites, may be limited.
3. USE OF THE APPLICATION
3.1. Users commit to using the Application responsibly, in accordance with the law, morality, and good customs, and to refrain from actions that compromise the security of the Application or other users.
3.2. Introducing false data, impersonating third parties, or violating applicable legislation regarding the displayed property information is prohibited.
3.3. ZHomes reserves the right to restrict, suspend, or terminate user accounts that violate these Terms or current legislation.

4. LIABILITY FOR INFORMATION
4.1. The Application displays property data obtained from ZHomes and other brokers via SPARK. ZHomes strives to keep this information up-to-date and accurate but does not guarantee the accuracy, availability, or validity of the published data, especially those provided by third parties.
4.2. The information presented does not constitute legal, tax, or financial advice. Users are responsible for evaluating the suitability of buying or investing in a property by consulting professionals they trust.
4.3. ZHomes is not liable for damages or losses resulting from reliance on the information displayed in the Application.

5. INTELLECTUAL PROPERTY
5.1. ZHomes is the owner or licensee of all intellectual property rights related to the Application, including but not limited to software programs, designs, source code, images, databases, logos, and registered trademarks.
5.2. Users do not acquire any intellectual property rights merely by using the Application and must refrain from performing any unauthorized exploitation acts. Reproduction, distribution, modification, or any unauthorized use of the Application’s contents is prohibited.

6. DISCLAIMER OF WARRANTIES
6.1. ZHomes provides the Application “as is” and “as available,” without any kind of warranty, whether express or implied.
6.2. ZHomes does not guarantee that the Application will be free from errors, interruptions, cyberattacks, viruses, or other harmful components.

7. CHANGES TO THE TERMS
ZHomes reserves the right to update or modify these Terms at any time. When significant changes occur, a prominent notice will be provided within the Application. Continued use of the Application after such changes take effect indicates acceptance of those changes.

8. APPLICABLE LAW AND JURISDICTION
8.1. These Terms shall be governed and interpreted in accordance with the laws of the State of Kentucky, United States, without prejudice to the application of other mandatory rules or international treaties that may be of public order.
8.2. Any dispute arising from the interpretation or compliance with these Terms shall be submitted to the competent courts in the City of Louisville, Kentucky, unless otherwise stipulated by applicable law.
